Welcome to Qbots. These Terms & Conditions ("Terms") govern your access to and use of the Qbots website, platform, applications, and related services (collectively, the "Services"). The Services are provided by Qbots ("Qbots", "we", "us", or "our") through the domain https://www.qbots.trade/ (the "Platform"). By accessing or using the Services, creating an account, funding your account, or otherwise interacting with the Platform, you agree to be bound by these Terms.

1. Definitions

• Account — the user account you create on the Platform, accessed via your login credentials.

• Platform — Qbots' web application, services, tools, and interfaces provided via https://qbots.trade.

• Services — the Platform, mobile/desktop apps, features, documentation, APIs, and support services.

• Fuel Wallet — a wallet or internal account used to deposit credits/crypto to cover fees or platform charges.

• Subscription Tier — the pricing plan or Service level you choose (e.g., Starter, Pro).

• Bots / Strategies — automated trading strategies offered on the Platform.

2. Eligibility & Account Registration

You must be at least 18 years old (or the legal age in your jurisdiction) to use the Services. By creating an Account you represent that you meet this requirement and will provide accurate, up-to-date information. You are responsible for keeping your credentials secure and for all activity under your Account. We may require identity verification (KYC/AML) and may refuse, suspend, or terminate Accounts where necessary for compliance or risk management.

3. Services & User Responsibilities

Qbots provides a non-custodial trading automation platform enabling Users to configure and run Bots that place trades via third-party exchange APIs. Users are solely responsible for configuring Bots and setting parameters. Qbots does not provide financial, tax, or legal advice and is not responsible for trading results or losses.

4. Fees, Pricing & Fuel Wallet

Access to certain features requires payment of fees as set on the Platform. The Fuel Wallet holds credits or crypto necessary to cover commissions, transaction fees, or usage charges. Ensure your Fuel Wallet balance is sufficient; insufficient balance may pause features. Prices and features may change; payments are generally non-refundable except where stated.

5. Payment Methods & Wallet Funding

Fund your Fuel Wallet using methods displayed on the Platform. Transaction processing depends on blockchains and third-party providers; you are responsible for sending funds correctly and complying with on-chain requirements (e.g., memo/tag). Qbots is not responsible for funds sent incorrectly or blockchain delays.

6. Refunds & Chargebacks

Payments are final and non-refundable unless stated otherwise. If you suspect an unauthorized charge, contact support immediately for investigation. Chargebacks or disputes may lead to account suspension and recovery actions.

7. Acceptable Use & Prohibited Conduct

Use the Services lawfully. Prohibited conduct includes attempting unauthorized access to other accounts, disrupting the Service with bots or scrapers, market manipulation, money laundering, reverse engineering, uploading malware, or impersonation. We may investigate violations and suspend or terminate accounts as needed.

8. Privacy & Data

Our Privacy Policy explains how we collect and use personal data. By using the Services you consent to those practices. We collect transaction, usage, and system data as necessary to provide the Services and prevent fraud.

9. Intellectual Property

All intellectual property in the Platform is owned by Qbots or licensors. You are granted a limited license to use the Platform for internal purposes and may not copy, modify, or create derivative works without permission.

10. Third-Party Exchanges & Integrations

Services rely on third-party exchanges and APIs for order execution. You must comply with any third-party terms. Qbots does not guarantee third-party availability or performance and is not liable for issues caused by external providers. By connecting an exchange, you authorize Qbots to place and cancel orders per your Bot parameters; we never request withdrawal permissions.

11. Security & User Obligations

Maintain security of your Account and API keys; enable 2FA and follow security best practices. Qbots uses commercially reasonable measures to protect the Platform but cannot guarantee absolute security. We are not responsible for losses from compromised credentials or user negligence.

12. Service Availability & Disclaimer of Warranties

The Platform is provided on a "best effort" basis. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." QBOTS DISCLAIMS ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Risk Acknowledgment & Limitation of Liability

Trading cryptocurrencies carries significant risk. Qbots and affiliates will not be liable for indirect or consequential damages. Qbots' total aggregate liability shall not exceed the amount you paid to Qbots in the six (6) months prior to the event, except where prohibited by law.

14. Indemnification

You agree to indemnify and hold harmless Qbots from claims arising from your use of the Services, violation of these Terms, or illegal conduct.

15. Termination & Suspension

Qbots may suspend or terminate access for breaches, security, or compliance reasons. Upon termination your access ceases and certain data may be retained as required by law. Fuel Wallet balances are subject to refund and forfeiture rules described above.

16. Dispute Resolution & Governing Law

These Terms are governed by the laws of the jurisdiction in which Qbots is incorporated (replace with your governing law). Parties will attempt informal resolution first; if that fails, legal remedies may be pursued in competent courts of the governing jurisdiction. Qbots may seek injunctive relief where necessary.

17. Modifications to Terms

Qbots may update these Terms from time to time. Material changes will be published with a "Last Updated" date. Continued use after changes constitutes acceptance of the revised Terms.

20. Miscellaneous

Entire Agreement, Severability, and Assignment clauses apply: these Terms (with referenced policies) form the full agreement. If any provision is invalid, the remainder remains effective. You may not assign your rights without Qbots' consent; Qbots may assign these Terms to affiliates or successors.
